F/T student – break from study due to illness

    I have a case under appeal from a f/t student whose studies were suspended in February 2010 as he became seriously ill. In April 2010, he claimed and was awarded ESA(IR) and therefore, eligible for HB/CTB from date ESAIR awarded.

    He claimed backdated benefit to February 2010 when his studies were suspended and i believe that he is inelgible for HB/CTB between feb and April ’10, as he does not fall into category of eligible student.

    I assume that he becomes an intercalating student from the date that he recovers from his illness. What are the ESA rules on f/t students taking abreak from study and how is he entitled to ESA.

    Guess it depends on when the illness actually started or the SoS decided the claimant was incapacitated. These threads pretty much sums it up.
