gainfully employed?

    Does anyone know of any definition of ‘gainfully employed’ in relation to self-employment. We are increasing getting cases where it appears claims based on s/employment which show that no sales/takings or even expenditure has been incurred for a considerable period after s/e commenced(ie 18 months later).
    Anyone would think that people went on the s/employed route in order to avoid being avalaible for work for jsa purposes and for the access to tax credits – surely not? 🙄

    I’ve got a case (waiting to be heard by TTS) that sounds remakably similar to yours Trevor. The definition i found on the HM Revenue & Customs website might be worth considering.
