    We have a previously single parent in receipt of IS on HB/CTB who has children with a man from Ghana. This man has recently moved in with her and she has informed us of her COC.

    The JCP will not award IS as a couple and it remains in her name only.

    He was previously working and has a NIN0 but he has now overstayed and is being dealt with by the HO.

    My question is, how do we include him on the claim – he has a NINO but is an overstayer, does that affect how we treat him?

    Just include him as normal in the HB and CTB as we cant disregard etc. He wont increase the applicable amount for IS so they are correct in only awarding a single person IS.

    If he has any income let the DWP know as his income will be taken into account on her IS claim.

    Apart from that, same as normal.

    Thank you Steve. For any future situations, can you tell me what you would do differently if say it were a std claim – would they be eligible for the usual couples premiums in this case?

    Yes they would get the normal couple rates of everything as we cant disregard. But IS, JSA(IB) and Pension Credits would ignore the partner for applicable amounts but include both parties income and capital in the assessment.
