HB before moving in

    Wonder if anyone has a way round this one.

    Claim made 17.5.06 – tenancy began 1.5.06 – claimant moved in 21.5.06

    claimant is disabled but was not waiting for adaptations (his mum couldnt help him move in til 21.5.06)

    Not waiting for social fund payment/previously lived independantly so not leaving hospital or care home

    I have said i can’t pay for the period prior to him moving in? is this right?

    From what you’ve said, I’d agree with the decision to refuse benefit prior to occupation.

    They had not moved in and do not meet any of the criteria for benefit prior to moving in. So will not be able to claim benefit for the period before moving in.

    Sorry me again…….. would the decision not to pay be under Section 130 sscba?

    Reg 7(8) of the HB Regs 2006 would do?
