HB Overpayment recovery

    Hi,
    We’re currently looking at ways to improve our recovery rate, one idea we have is to take over the Court action (with N322A submissions) from our Legal Department, as recovery is inclined to slow down a bit when it gets to this stage.
    Having read up on it, it appears quite straight forward, but it would be great to discuss with someone who is already doing it within their HB Section.
    Is it as straight forward as it appears, what details do you put on the form, what costs are there other than the actual submission cost i.e, do you charge interest (when for & to when)???
    As you can see I have a few questions! Our Legal Deparrtment might not release it to us but I’d like to have answers ready to any questions that might get thrown up.
    Hope someone can help

    We would like to do this but the Legal section won’t give up their area of work! If you take it on the hard work is in enforcing the debt – obtaining judgement is the easy part

    Hi
    I have been applying for Awards (N322A) within Benefits dept for over 2 years now, and it works just fine for me. I do think it speeds up the Legal recovery process, the communication between us & our Legal dept is excellent. Once you have the Award you can then get your Legal Department to do the rest as in Attachment to Earnings etc, so in effect you do all the “Donkey work” as some would say & then Legal have the power to do more.

    It is fairly straight forward although you do have to complete the Application to Enforce the Award correctly no errors allowed but it is quite simple. Our Legal Department have an account with our Courts so we can ask the court to deduct the court costs/fees from this account, then our Legal Dept just bill our department. We also charge interest along with the court costs but only at the time of applying for the Award but the interest and court costs are only added to the debt once the Award has been obtained.
