HB Prior to Occupation

    Claimant becomes liable for rent at her new address while still in hospital. Her tenancy commences on 31/08/06 but she is unable to move in until 18/09/06.
    Her daughter (who works full time and is not getting carers allowance) moves in with her mother to look after her also on 18/09/06.

    The claimant is entitled to HB (prior to occupation) from 31/08/06, but should her ND daughter be put on the claim from 31/08/06 or 18/09/06?

    Was the daughter always intending on moving in, or did she only decide to move in after her mother became ill?

    If the daughter only moved in because Mum became ill then I’ll go for 18/9/06.

    I think the daughter is only moving in because the mother became ill. She was going to give up her work to care for her, but changed her mind.

    How old is the claimant? If she is over 65 then non-dep deduction would not be applicable for the first 26 weeks in any case.

    Also there is no non-dep deduction if the non-deps home is normally elsewhere.

    I may not have got the facts straight, but is sounds as though the daughter is only there temporarily. In which case I would not include her as a non-dep at all.

    ok thanks. The claimant is only 48. The daughter was staying with relatives prior to moving in with her mum, but I think she would now class her mothers house as her home.

    In that case I would take the npn-dep deduction from 18/9/06
