Housing Allowance from Employer

    We have a claimant who is receiving a Housing Allowance from his employer in his wages. The allowance exceeds his contractural rent. He has claimed HB. How do I take this payment into account? Is he eligible for HB? Common sense would say No as his employer is meeting his Housing costs but this is HB!! Or is he eligible in principle and can I just include this payment as part of his earnings?

    Off the top of my head; it is remuneration derived from employment. Therefore, earnings.

    The above response assumes there is no connection between the employer and the landlord.

    I presume it’s not tied accomodation?

    As far as I am aware the accomodation is not connected to the employer at all. The tenancy agreement has been provided and there is no evidence to suggest there is any link between the property and the employer.

    In that case I think Kevin is correct. It’s not an allowable expense so treat as earnings.
