How do I get a RO decision for 05?

    It’s come to light that although someone moved back in 2005, we have continued to apply to the RO for a decision giving the old address 9although all other details are correct).

    They are unable to provide substitute decisions and I wondered if anyone new how I can apply for a decision 6 years late!

    HBR17 doesn’t cover this situation. You can only apply for a substitute decision if there was an error in the size of the property, number of occupiers, compostion of household or nature of the tenancy. All this was correct. We simply quoted the wrong address. The correct information has been applied to the wrong property.

    I agree Reg 17 doesn’t cover it, but I reckon Reg 15 does! I can see nothing to stop you making six redetermination applications – I am sure the Rent Officer must have done something in this life or a past one to deserve it.

    Just to update this thread.

    The RO have informed me that they cannot consider redetermining our original decisions because they were made for a different address. There have never been any decisions made for the correct address for them to reconsider. SoI noe appear to have 6 years benefit awarded without an RO decision!

    Send them a bottle of scotch with your next redetermination request. Never fails. 😉

    Seriously though, it might help if you give them a call, explain the situation and ask really nicely… Its not like they have to go back in time to visit the place, they must have enough data to provide what you need.

    I’ve spent 20 minutes on the phone to them arguing my case. As far as they are concerned we are out of time to make an application for past years (they have to be made by the 31/5 each year at the latest) and we cannot ask for a reconsideration because a decision has never been made for the correct address to them to reconsider. Apparently they have run this past their own guidance team and can find no way around it.

    I tried to argue (rather hopefully) that we had applied for the right address, we had simply the wrong one down, but they wouldn’t have that!

    I trust that a brain much sharper than my own in HBInfo land can help.

    I’m still unable to find a way of getting decisions for the past 6 years on this case but do at least have a new decision for this year. My next question, is when is this effective from. Effectively its the first decision made on this claim, but cannot be effective from when it commenced, only from this year. Do people agree that it should be applied from the 1 April 11?
