Income from capital

    We have a claimant who is unable to manage her affairs so she has a client account with a firm of solicitors. The account now has £3k in it and each month the sols give her £370 for living expenses. CL has no other income. Is this monthly income disregarded as “income derived from capital”? CL also has a discretionary trust with £35k we are disregarding so we could be awarding max HB with no income/capital. Thanks.

    It is not income. She is simply spending her capital. Are you sure she has no other income? Is it not more likely to be the case that she does have other income which is paid directly into the client account? Otherwise it is not going to last her very long.

    Claimant did state she would apply for JSA back in July but this never happened and she has no other income.
