Interpretation of prescribed classes of dwelling

    What may appear to be a stupid question!

    SI 2003 No 3011 the citation,commencement and application states that the regs apply to England only.

    Class A the class of dwellings described in this regulation (class A) comprises every chargeable dwelling in England

    a. Which is not the sole or main residence of an individual

    Now does this apply to England i.e do both properties being considered have to be in England. Someone living in Scotland this would then be their sole or main residence in England and the scottish property disregarded?

    No I have a Council Tax member asking in general

    sorry then, I’m being a bit dim, do you mean that they have their sole or main residence in Scotland and a second home in England, or vice versa? But in either case I don’t see that it matters, they can only have one S or M.
