Has any one come across the scenario where a mistake has been made by the IR in respect of a Tax Credit award, and when queried by the LA the response is that the claimant must write to ask for a new decision? Even is the error is clerical and an income of £30k has been entered as £300k!

IR are refusing to look at the award again despite the error was made by their offices.

Ok, the claimant may spot the mistake, but it seems a bit unfair ….

This happened to a few of our customers last year and I wrote to the customers advising them of a “possible” error and to contact the IR to query their award. In the majority of cases the mistake was rectified following a telephone call from the customer ……. they did not have to write to the IR to ask for a new decision.

In one instance, non taxable Incapacity Benefit had been used in the calculation……. the result was an underpayment of nearly £2000.
