Irish Incapacity Benefit

    We have a claimant originally from Eire who receives an Incapacity Benefit from the Irish Department of Social Protection.

    I need to know if we can treat this as we would Incap Ben and award a disability Premium.

    We have tried calling the DWP but they didn,t know, and I have also tried contacting the Adelphi with no luck as yet. I really need to have a definitive answer that if it is against what the claimant wants would stand up under appeal.

    Any help advise gratefully received.

    Thanks Kay for the link, however this ic counted as income just as the old Incapacity Benefit my problem is whether he is entitled to the Disabled Premium in his Applicable Amount.

    I have found several web sites explaining what the benefit is but none to say whether an income from another EU country qualifies for a DP.

    I think your approach should be less about the income triggering anything (as it doesn’t in itself) but whether or not they satisfy any of the other prescribed conditions that qualify someone for a DP such as being incapable of work for 364 days or more.
