IS A DECISION ON DHP PURELY AN ARITHMETIC EXERCIES

    IT IS OUR OFFICE PRACTICE THAT WE WOULD ONLY AWARD DHP WHERE A COMPARISON BETWEEN A LIST OF EXPENDITURES INCURRING BY THE CLAIMANT AGAINST HIS INCOME SHOWS THAT THE CLAIMANT WEEKLY EXCEEDS HIS INCOME.

    THIS PRACTIVE GOES IN LINE WITH WITH REG 2 (1) DHP REGS WHICH STATES THAT DHP MAY MAKE PAYMENT WHERE IT APPEARS TO THE LA THAT THE CLAIMANT REQUIRES FURTHER ASSISTNACE WITH HIS HOUSING COSTS. IN SHORT AS FAR AS OUR OFFICE IS CONCERNED, THE DISCRETION IS EXERCISED CLINICALLY TO BE BASED THE DIFFERNEC BETWEEN WEEKLY EXPENDITURES AND INCOME.

    I HAVE THIS CASE WHERE THE LIST OF EXPENDITURES PROVIDED BY THE CLAIMANT IS BELOW HER WEEKLY INCOME SUPPORT AWARD, HOWEVER, A HOME VISTING OFFICE WANTS US TO LOOK AT THE CASE MORE FAVOURABLE TOWARDS THE CLAIMANT AS SHE IS PLAGUED BY A NUMBER OF ILLNESSES AND SHE IS ON THE VERGE OF BECOMING BLIND. THE HOME OFFICE STATES THAT HAD THE CLAIMANT NOT RESTRAINED HER HER BUDGET SO TIGHTLY SHE WOULD NOT BE ABLE TO AFFORD PAYING THE SHORTFALL BETWEEN HER RENT AND LHA. IN THE VIEW OF HER MEDICAL CONDITIONS SHE SHOULD BE AWARDED DHP IN ALLOWING HER SOME BREATHING SPACE.

    ALTHOUGH I WANT TO PAY HER DHP BUT I AM NOT SURE I SHOULD AS IT APPEARS ON PAPER THAT SHE COULD MANAGE TO PAY FOR THE SHORTFALL ALBEIT THAT SHE HAD TO DO IT IN SUCH A WAY THAT HAS A DETRIMENTAL EFFECT ON HER HEALTH.

    If you just take the income expenditure route then all a claimant needs to do is sign up to a high subscription to mobile/internet etc so their income falls short of their expenditure. We would look at this and ask the claimant why they are spending so much on “luxuries” when it is detrimental to their current situation. This would be looked on as the the LA was then subsidising the person to live outside their means – not what DHP is meant for.

    In your case – if the person is struggling and has already made cuts to thier expenditure to try to pay their rent/outgoings themselves but is still strugling then we would look at this favourably, especially if they have mediacal problems and would face further difficulties if they were forced to move.

    This does not mean we would pay a DHP for ever – we would encourage them to either re-negotiate their rent with their LL or look for cheaper suitable accomodation.

    I’d also suggest that DHPs are discretionary – so in fact if you wished to make a payment where there is no shortfall, there is nothing to stop you doing this. We have made similar awards but as Scott says, for a short term period to help them stabilise their situations.
