IVA’s and Administration Orders how do we treat them?

    Can anyone suggest where I can find further information or relevant legislation regarding the treatment of Individual Voluntary Arrangements or Administration Order’s?

    Can HB still be recovered from ongoing benefit? I know there was a similar post recently and only one reply was posted but there was no legislation quoted or referenced.

    As far as I know – an IVA is simply an ‘official’ way of negotiating with your creditors to reduce your repayments for unsecured debts and to have parts of your debts written off eventually. I can’t see that it has anything to do with benefit debts ie overpayments so there isn’t likely to be any legislation mentioning it.

    refer to the DWP Overpayments guide, paragraphs 7.130-7.134
    and to U6/2006 Circular

    You can recover overpayments from ongoing HB where there is a bankruptcy or Admin order and I can only assume it’s the same for IVAs. Hope this helps
