    Hey,

     got a case where an italian national has applied for JSA(IB) not been successful, but insists that she is looking for work,and cannot secire any,

     

     how do i view this in relation to reg 6 EEA 2006 – can she get a right to resiee as a job seeker in this circumstance

    You need to give more info than that..basically a “job seeker” that retains “worker” status is fine….a proper job seeker with no history, even if they have prospects of getting a job, have nothing to retain so must rely on JSA(IB).

    Yep, and HBR 10(3)(B)(f) is the jobseeker that retains the worker status by virtue of EEA regs 6(2).
