Joint Owner – Land Registry Entry

    We have received a new claim for hb/ctb and the claimant is still registered as a joint owner of a previous property on the land registry records. He has brought documents in from a solicitor to confirm the mortgage on this property was transferred over to his ex partner several years ago.
    Do we still have to treat the claimant as being a joint owner of the former home?


    It sounds as if this is not the property the claimant is claiming HB for: I thinik the issue is capital.

    If that is right, the question is whether the claimant retains any beneficial entitlement to the capital value of the former home. The documents from the solicitor will help you with that. If the intention was that the claimant simply walked away and washed his hands of the property, then it doesn’t matter that he retains joint legal ownership – his legal ownership would be in the capacity of trustee for the sole benefit of his ex.
