Landlord bankruptcy and hb

    A scenario for a Friday afternoon! A landlord has gone bankrupt and we have continued to pay hb after this date because we were notified late (we were notified after one month if this makes a difference), the ownership has now changed and hb is to be paid but we do not know which date to amend the payee from. We are not sure whether to amend the claim from the date ownership changed thus creating an overpayment for the bankrupt l/l or whether to change it from the Monday following the notified date meaning the new l/l will have to recoup the money from the bankrupt l/l. Can anyone help?

    In my opinion, you simple make the next available payment to the “new” L/L.

    There is no overpayment – this can only happen if the CLMT is entitled to less HB than has been paid.
