late appeal – daft question

    Afternoon

    Forgive the daft question but if I get an outwith 13 month appeal, do I need to do any kind of submission or can i get away with just an AT37? (in my defence, my only appeals officer has been made redundant!)

    You would need to do a short submission explaining that it has been submitted outside of 13 months and asking them to strike the case out under Rule 23 of the Tribunal Procedure (First-tier Tribunal)(Social Entitlement Chamber) Rules 2008. Include evidence of the decision letter and the letter of appeal and a judge will decide whether it can be admitted. Make sure you put on the AT37 that it is a late appeal and is unsupported.
