Late notification of Carers Allowance Ending

    I have a claim where the claimant has just notified our office that his carers allowance has ended along with other changes to his claim.

    A call to the Carers Allowance department has confirmed this ended on 9/3/2005 which ties in with the date his partners DLA reduced from middle rate to low.

    Would this change only be taken into account from when we were notified as it will be an advantageous change or would it go back to 9/3/2005.

    The regulations seem to only state that we can go back if a relevant benefit is awarded or increased but does not state if one ends?

    If they are then Yes I would only supersede from the date of notification of change, but if they are not you may have to amend the CA/ CP issue to calculate a correctly netted down OP.

    I think this makes sense but if it doesn’t I’ll re edit it!!!

    Do I know what I'm doing? The jury's out on that........................
