    We had a late request for reconsideration which was denied as the claimant didnt give reasons for lateness. does the claimant have the right of appeal against the decision not to reconsider?

    I know that they can request a further reconsideration so it seems odd that they would have the right of appeal, but I cant find it in black and white! 🙁

    I dont think they can request a further reconsideration, but they can certainly submit and appeal, and as it will be late the normal late appeal procedures apply- if they dont give a reason this time, just send it as a late unsupported appeal!

    It is sched 7 (6) Child Support, pensions and Social Security Act 2000 that gives them the right to appeal.
