LHA Moot Point

    I asked an assessor to have another look at this claim………

    Couple, 1 child living in a 2 bed flat.  Tenancy in her name.

    The Couple then split up, he wont leave or contribute to the household.  She is taking steps to remove him.  Police etc are involved so I dont doubt that this is the case


    The processing team made her 50% liable for rent & CTAX, however as she is the tenant, I can see no grounds for this.

    However as they have pointed out, were we to treat him as a non dep, she would then get the 3 bed LHA rate – which is higher than the actual rent she is paying (This is the point where I must add I am not an expert on the ins and outs of the LHA rules)

    Any sugestions as to a possible way forward?  I cant see that we have any grounds to simply ignore his presence in the household, or do we just treat him as a non dep?

    Treat him as a non dep, your system won’t pay more than the eligible rent


    Yup, nowt else to do, have to give the extra room and then take the appropriate deduction.


    Non-dep is the correct solution. She is the sole tenant so should have 100% responibility.
