LHA top up lost

    Hi All,

    I have the following scenario-

    Mr X lives in a property with a rent of £45 per week. The LHA rate is £60 so he got the £15 top up. His daughter moves in with him and he is entitled to a 2 room rate. The computer system wants to recalculate the HB and remove the top up……is this correct. Seems a bit harsh that he loses the top up just because we alter the rate of LHA to a two room rate. ?

    If the daughter moved in after April 11 the new rules apply so; no excess payment; entitlement based on lower of rent or LHA Rate; no protection if reduction is only due to loss of excess.


    Similar scenario here whereby a child reaches 16, resulting in an increase in the bedroom requirement / new LHA anniversary date. The original claculation would have continued with the £15.00 excess for a couple more months.

    Always struggled with the concept of excess payments when originally introduced!! 😀 😀
