Liability Query

    Difficult, PV, Council tenant imprisioned January 2005 and not to be released until out on licence in September 2006, with licence preventing return to property.

    His son remains in property and was awarded Income Support when his father went to prison. However he was not 18 until February 2006.

    Have issues with the Housing Department and Legal Department over the tenancy as I believe they want the tenant out and don’t want the son to receive benefit as he is not liable !! However if the son is resident and should he be considered for benefit. He has not made any rental payments as he is on Income Support but he is occupying the property as his home !

    Should the son be treated as liable to make payments? Unless the son only moved in because the tenant knew he was likely for a stretch in HMP, thereby perhaps contriving the liability, I would pay HB to the son.

    Do I know what I'm doing? The jury's out on that........................
