LIABILITY TO PAY RENT

    Can someone help….

    Claimant has terminated her tenancy and her notice period has ended, however she has refused to move out and the RSL are now charging rent on a daily basis until they decide whether to renew tenancy or take steps to remove from property.

    As the RSL are holding them liable for rent I am assuming we are ok to treat as liable and pay benefit.

    Can anyone confirm whether this is the case or not, the RSL states that if the rent gets paid (via benefit) for this period of no agreement then they will offer a new tenancy.

    The short answer is yes, its known as mesne profits and is eligible for HB
