Libya – British passport holder flees to UK, can he claim HB

    Hi all,

    Our homeless dept are dealing with a family who have recently arrived from Libya. Family has been living in Libya for several years; they previously lived in UK and still have family/ friends in this country. Family composition is Claimant (British passport) + wife + daughter + 3 grand children. Not sure if other family members have British passports. They were living in Tripoli!

    Are there any special rules for people fleeing Libya?

    Can they claim HB if they satisfy HRT?

    No special rules as far as I am aware. As per normal returning nationals they need to satisfy the 2nd part of the HRT and depending on this you will be able to determine HB.

    I did one very recently for a british lady who had returned from Libya where she had been residing for the last seven years. She made a claim for JSA, which was refused, she appealed and won her appeal.

    Steve is right, as long as your clmt satisfies actual habitual residence then there is no reason why you cant pay.
