Limited leave to remain – can he claim?

    Claimant came to the UK 4 years ago from Zimbabwe

    His documents confirm he has limited leave to remain. His documents do not state that he has no recourse to public funds.  His leave to remain expires December 2014.


    He is full time student.

    Can he claim?


    He is not excluded from benefits by virtue of his immigration status – five years’ limited leave with no restrictions on claiming public funds is normally associated with refugee status or leave on human rights grounds. If it doesn’t say no recourse, no such condition has not been applied and there is nothing to stop him from claiming HB.

    However, none of that matters if he’s a full time student …
