Lithuanian property owner.

    Hi

    I have a case where a Lithuanian national has declared that they own a house that is their main residence in Lithuania.

    Apart from valuing the property, could we refuse benefit on the fact that although they are working here, they have not cut all ties with their former country as centre of interest is there, or have I got the EEA rules and Non-EEA rules mixed together.

    Any help would be appreciated.

    If they are legally working they pass theRight to Reside and HRT so no decision to make in regards to the property being the main centre of interests. You may however, have to take the value of the property into consideration.
