We have a customer who receives £600 per month maintenance via court order from her ex husband. She objected to the fact that the whole of the amount is taken into account, because the money she receives is used to pay their joint mortgage each month. (customer remains in the property). Customer was advised that the whole of the payment she receives as maintenance is taken into account and she has now provided a letter from the court to say that £350 of the maintenance she receives is an award towards the cost of the mortgage payment (of £550 per month). The full amount of maintenance is paid directly to her – the husband does not pay his maintenance element directly to the mortgage company. My question is – do we take into account a) the whole amount of maintenance as income b) the amount less £350 specified for mortgage repayments or c) maintenance less 50% of mortgage payment??
