Mesne Profits

    We have MOD properties in our area. Whilst the tenants have a tenancy with them they are crown tenants and in-eligible for HB.

    Once the MOD ask them to leave, they apply to the court for a notice to quit and the tenants are then charged damage for trespass (mesne profits) for which they can claim HB.

    Should these claims be referred to the RO once they are being charged mesne profits?

    That was pretty much my view – can’t see why you wouldn’t refer.
