    Q8 of Circular A8 confirms that the new provisions are subject to the DMA regs; This is fine – so if you have a rent change that takes place mid week and you get a late notification of a beneficial change in the same week, do the two changes have the same effective date? ie midweek

    Sorry if the question appears simplistic but hb is not simple anymore plus I have jetlag!!

    Absolutely right – by virtue of D&A Reg 8(3), the advantageous change is treated as if happened on the date when it was reported. If that date falls in the same week as another change, then you have two changes happening in the same week even though you are only pretending that one of them happened in that week. Under Reg 79(4) as amended, if one of the changes is a change in rent (or a change of address or the start/expiry of a two homes overlap) it overrides the other one and both changes are taken into account from the date of the rent/move/two homes change.
