New BVPI targets

    Is anyone reviewing their prosecution policy as a result of the new targets? Why bother to prosecute when you don’t score any more than a caution? We can easily reach our target without doing any prosecutions at all

    No change to policy here. Each case examined on its merits.
    Obviously those LAs out to make money will now opt for the Ad Pen route. Hopefully the number of cases that Ad Pens are refused on that don’t make it to the courts will be closely monitored by Audit & BFI.

    Re Proceeds of Crime Act: As you can recover the overpayment anyway what additional sums of money are you putting in the confiscation order to cover your costs? I was under the impression that you use POC legislation to recover the “benefit” to the claimant of their crime. I can see how undeclared income would affect their lifestyle and DWP might have a case for using it with JSA/IS but as far as HB is concerned what additional benefit is there other than the overpayment. I’m confused

    Hi,

    I have two concerns with this approach.

    1. A prosecution policy is not there to meet a target. Its purpose is to deter/prevent and provide suitable punishment for persons committing fraud.

    2. What would you do with the ones that didn’t admit the offence for a formal caution or refused the admin penalty; just let them off? :15:
