New claim – which month’s LHA figure to use?

    I’m just having a moment where I can’t convince myself one way or the other!

    New claim received Monday 29.9.08 for a tenancy that commences Weds 1.10.08. Clmt moves in 1.10.08 and we are happy to award LHA from that date.

    Question is do we use September or October’s LHA rate (they differ).
    One part of me says it is determined by the date of claim – 29.9.08 and so September rate. The other part says the tenancy actually begins 1.10.08 so October’s rate seems more logical. But when did that ever make a difference?

    Can someone put me out of my misery please? 😕

    I would use the October figure because that is when liability started. The claimant has a right to put his claim 13 weeks in advance but it doesn’t mean we use the month in which the request is made only, surely we need to look at liability start date….now I am confused as well. Sorry not helping much….

    Think you’ll find that the LHA rate should be determined by the date of claim not the date of liability, therefore as date of claim 29/9/08 you should use September’s rate.

    In the case of advance claims then I imagine that your date of claim would be set at a date within the week prior to entitlement otherwise your processing stats would look pretty poor

    Sorry to revisit this but we use I World and we have a mechanism for using a Treat as Made date.

    I now have a case where the claimant provided claim form and all infrmation 24.10.08 but although tenancy started 01.11.08, she did not move in until 08.11.08

    As we use the treat as made date of 08.11.08, would this mean that I would be required to use the October rate?

    Reason for asking is that then, her anniversary would be less than 12 months since she moved in whereas someone who made their claim on 01.11.08 would not have this issue!

    Does anyone have an opinion?

    I presume you are looking to pay wef 8/11/08 as date of move in.

    If this is the case than would treat date of claim any date within the benefit week preceding week of first entitlement. As that would mean a date between 27/10/08 – 2/11/08 then you could choose the most advantageous LHA rate accordingly

    I would have used Octobers rate here, but am now doubting that.

    Can anyone provide definite confirmation of this?

    The LHA rate used is determined by the date of claim so whatever you determine the date of claim to be you use that month’s rate.
