New rent liablity and new income support claim

    Just for clarification please:

    Claimant moves into refuge in our area on 20 November 2006. The rent is charged on a daily basis and she is charged from 20 November 2006.

    She makes a claim for Income support which is awarded from 21 November 2006.

    Can HB be paid from 21 Nov 2006 on basis of i.s. entitlement, or would this change only be effective from monday following i.e. 27 Nov 2006?

    Also, is there anything that would allow us to pay from 20 nov on basis of i.s. entitlement? (seem to think there was but may be completely wrong!)

    You can have a claim start date of 20th November since the claimant is on IS and made a claim within 1 month of being awarded IS.

    As far as I am aware there is not any qualifing days for IS like there is for JSA so in theroy you would have to have proof of her income for the 20th November 2006, though since it is only one day I would either enter a notional income for that day or just start the IS on the 20th.

    I would agree with Darren. I would pay first day on notional income (once claimant has confirmed no income) – claim made within same week of first liability.

    Even though the liability is daily, benefit for these cases remains an entitlemnt based on a benefit week. Therefore as liability and JSA entitlment commence on the same week there is no need for further verification for that day.
