Nigerian Claimant but familiy member of EEA full time student

    The claimant is Nigerian and has a residence card confirming she is a familiy member of a EEA National.She is inactive, not working and is no ta student.
    The partner is a full time student nurse ,holds a German passport. and also works part time for an agency . They have three children one of which is school age. The claimant arrived in the UK on 17/06/2008 and the student partner has been in the UK since 15/08/2006 . We dont have work history from 2006. This year is the first year of course.

    are they eligible for HB/CTB ?

    From what you have posted I can’t say no….unless there are any underlying factors. I’d pay.[so long as the EEA “partner” is stil exercising all treaty rights, that is] The fact he is working/has worked helps.
