Non dep and claimant is over 65 – part 2

    Non – dep vacates, then a month later they return.

    We were making deductions up to vacation, do we disregard the non-dep for 26 weeks now they’ve returned?

    The letter advising us that the non-dep vacated reads like the intention was to vacate permanently.


    I think so, yes.
    The 26 weeks starts again immediatly after one days absence.
    Of course, you will have to be sure that they did “vacate” for that month, but if you have information to that end, the 6 months non-dep delay starts again.

    In your case, being away for a month presents no problem (in my opinion).
    But if a non-dep is “away” for just 2 or 3 days, you may wish to be more suspicious. 8)
