NON DEP AND SINGLE OCCUPIER DISCOUNT

    Hi

    i have a claim where ctax have removed the customers single occupier discount as they say she has a non dep in the property.

    the customer has confirmed her son is in the armed forces and only returns when hes only leave. however he sleeps at his girlfriends house not hers.

    however as he is registered for voting from his mothers and ctax have said if he didn’t have a girlfriend he would be staying at his mothers they are including him as part of the property and will not reinstate her sod.

    this now means we need to reassess her hb and ctb based on the fact she has a non dependant in the property. is this correct? as i think it seems a bit unfair.

    any advise would be appreciated 🙂

    Where do the Armed Forces (or anyone else for that matter) hold his contact address as. You could use such caselaw as Anderton and Stark (to mention but two; Cox & Codner also spring to mind) in determining where he should be treated as living.

    Do I know what I'm doing? The jury's out on that........................
