Non-dep moving out/in – date new LHA rate applicable

    Please could you let me know your views about the following scenario.

    Non-dep moves in on Monday 5 May 2008. The claimant is entitled to an additional bedroom so will receive a higher LHA rate. Will this rate be applicable from 5 May or 12 May 2008? If its 5 May would you still take a non-dep deuction from 12 May? So HB would go up for one week then down again?

    Both the following Monday – a change of household affecting the LHA has no special rules in the Decisions & Appeals Regs, just as it has no special rules when the LRR/CRR is affected. It is just a general change of circumstance, so the superseding decision is made under Reg 7(2)(a) and 8(2).
