Non-Dependant liable for C/Tax??

    Can anyone point me in the right direction here and let me know which Legislation to refer to please?

    We have a case where the Tenant of a dwelling is currently being paid Housing Benefit. She does not receive Council Tax Benefit because she is under 18 and therefore not liable to pay Council Tax.

    Her friend has just moved in as a non dependant but the friend is not named on the lease and is not a joint tenant. However, the friend is 18 years old.

    I am told that the friend will now be liable for 100% of the Council Tax Liability but I cannot find the specific legislation that says so. I have looked at the LGFA1992 and the hierarchy of liability but I cannot see that the non-dependant in this case becomes liable as they do not have equal interest in the property.

    Can anyone help?
