Non dependant or lodger?

    I have a claim where we were paying claimant based on i/s. Then we find out someone moved in and claimant has declared this person as a lodger to DWP paying her £55 pw rent (this was back in 2009).

    Claimant notifies DWP in 2010 that the lodger is off sick and she has reduced his charge to £25 pw.

    Now claimant has come off of i/s and started work. We have asked her to confirm details for the lodger and she has now said she is charging £20 pw.

    From the information I have it would appear that this is not a commercial arrangement and therefore the other adult should have been included as a non dependant. However she has declared the income to DWP.

    What are your thoughts on this please?
