I am hoping someone can help with this as my brain has not yet recovered from the weekend (must of been the lack of alcohol).

We are notified that a NDEP has went on holiday to Poland on 7/11/06 and was going for a fortnight. We have just been notified today that he and his girlfriend have decided to stay on in poland and tour across europe and will now not return until April or May next year.

How should we treat this person?…..

Should we continue to treat him as a NDEP and request details of his income as his intention is to return to the property. or.

Should we remove him from the benefit records and remove the NDEP deduction while he is away.

((why do people ask me these questions before I have even had chance to get a cup of coffee in the morning))

Any help would be greatly appreciated

The definition of a non-dep is a person who [b:cd539a3d27]normally resides [/b:cd539a3d27] with a claimant.

My view is that in the scenario you describe, the non-dep normally resides with the claimant, and as such a non-dep deduction falls to be taken even whilst he is abroad.

Obviously, unless he is working whilst he is abroad, only the lowest deduction should be taken.

I agree it appears a little unfair, but you could always offer the claimant a DHP…
