Non-dependent with no recourse to public funds.

    We have a case where the non-dependent couple were in receipt of JSA(IB) but the partner has no recourse to public funds.
    No problem so far, we just included the non-dep couple on to the claim based on their JSA(IB).
    Then, the husband is sent to prison, leaving the partner who has no recourse to public funds.

    My question is – What is the correct way of dealing with this situation?

    The CTAX Team have allowed a Single Person Discount to the liable persons CTAX Account so would it be correct for us to leave the non-dependent off the claim?

    All suggestions will be appreciated,

    I am not too sure why your ctax team have awarded an SPD but as long as the PFA partner is resident at the address then the non-dep deeduction would apply. probably on the minimum deduction though.
