Notifying CIC when post ‘goes missing’

    I’m after some caselaw/comms decisions that refer to a claimant insisting she/he notified a change in circs by letter but that the LA did not receive it. In the back of my mind there was a recent-ish case where the judge found in the claimant’s favour over a case like this. Can anyone help?

    I don’t really see how a CD would help. You can’t point to a case and say, in this case the judge ruled that the claimant had not sent the letter so that must also apply here. Each case is decided on its individual merits. For example, does the claimant have a history of corresponding by post? If they’ve typically reported changes in person that could mean its less likely that a letter was sent. Did they send any original documents with the letter? If so, why didn’t they contact you and query their return?
