Old Reg 11

    Hi
    I’m trying to find ‘Old Reg 11 as worded on 1st Jan 1996’, which is about restricting eligible rents to that of suitable cheaper alternative accommodation for vulnerable claimants, in the new 2006 regs. I guess we would have to call it ‘old old reg 11’ now and I’m having trouble finding it’s equivalent in the new regs. I’m wondering if anyone can help.

    The text, as worded on 1.1.96 is reproduced in the Reg 11 analysis in the Findlay for 2005/06 at page 267. I’m not offering to type it all out as , if I did, you’d never get the reply!!

    I presume it will be with Reg 13 somewhere in the 2006 Regs but hopefully someone else with a better brain than me will find it!!

    Hi Mark
    I’ve looked through new Reg 13 and can’t find anything that is similar to ‘old reg 11’. Schedule 2 in the new regs talks about excluded tenancies, however I can’t find the section all about vulnerable claimants and being able to restrict there rent if it is unreasonably high and there is suitable alternative accommodation elsewhere.

    Try Schedule 4, Paragraph 3 of the HB/CTB (Consequential Provisions) Regs. It’s a long trawl through but would seem to cover what you are looking for.

    I do see what you mean, though. It’s not particularly obvious and I suppose the Powers That Be decided that as we’re this much further on then these cases won’t exist!!
