Does anyone know if legally we can make people 'opt-in' to the new localised council tax support scheme. i.e. unless some-one registers for council tax support then we would not migrate them from council tax benefit and they would not receive any CTS. If legally we can/can't please could you refer me to the right regulation?

    Schedule 4 – 9(2)

(2)Such provision may include, in particular, provision for and in connection with treating a person who is or was in receipt of council tax benefit, or who makes or has made a claim for that benefit, as having made an application for a reduction under a scheme.

Many thanks for your reply Jeff.

I have had a quick look at the prescribed and default regs issued last week, I might be in a monday morning mode but unfortunately, I could not locate the above. Could you help me by sending a link if possible. Cheers
