Out of court settlement re personal injury payment

    I have a pensioner claimant who received a lump sum payment of £30,000 a few years ago as an out of court settlement in respect of a personal injury.
    Sch 6, part 17 of the 60+ HB Regs says that we disregard such sums as capital if they are administered by the High Court (etc).
    My question is, is such capital disregarded (for 60+ cases) for an out of court settlement? Does an out of court settlement count as being a payment “administered by the High Court”?
