out of Jurisdiction and Late appeals

    Has anyone had a problem with the appeals service extending the time limit of appeal beyond the 13months absolute time limit and allowing out of jurisdiction appeals please?
    we have had a few since the begining of this year. The latest ones which have come back are
    1. overpayment which was notified to claimant and landlord in 2002
    2. decision re applicable amounts

    O/13 months limit passed – Only the once in 2004 and TTS did accept that they’d got it wrong (not until after we’d done a full submission though!)

    OOJ appeals are more problematic in that they (TTS) look at giving the appellant their “hour in court” before saying “sorry, there’s nothing we can do” using the interests of justice loophole.

    Do I know what I'm doing? The jury's out on that........................

    YIP, had a few admitted, TTS state that it is against the [i:4a1a91e33e]calculation of HB[/i:4a1a91e33e], not applicable amounts, therefore, they admit it to hearing, only for you to go along and the appellant gets told that there is nothing that can be done as the income supplied doesn’t qualify for benefit – what a waste of time !!!

    The worst case that I had was a case from [b:4a1a91e33e]1999/99[/b:4a1a91e33e] that was admitted!!!!

    it didn’t matter what argument I put forth re OOJ, the chairman wanted to hear it !!!!!!! (obviously the chairman was wanting some money for his holidays)
