Overpayment recovery

    I am currently checking a claim where 2 sisters were jointly renting a property and made seperate claims for HB and CTB.

    One sister moved out and the remaining sister’s claim has been amended to take into account the full amount of rent and CTax (minus SPD). However, the claim of the sister who moved out had an overpayment created on it when it was cancelled and this has been transferred over to the remaining sister’s claim and is currently being recovered from her.

    I can only find info relating to recovering o/p’s from partners – does anyone know if it is ok to do this?

    No it is not OK to do this!!!
    You cannot recover from the remaining sister just because she happened to be a joint tenant of someone who once had an overpayment but then moved out. You should stop recovery and refund anyhing already recovered and then chase the overpayment from the sister who was overpaid.
