Overpayments – Non HRA/RA or HRA???

    1.
    Customer moves address from Non HRA Hostel to privately rented accommodation. A claim is set up for the new address, however, the old landlord code is brought over in error and the first payment due on the RA address is sent to the Non HRA Hostel landlord. Is this a RA overpayment or a Non HRA overpayment?

    2.
    Similar to above. Case currently in payment at RA address. Benefit then processed retrospectively for Non HRA address. Landlord details amended to Non HRA landlord so that this claim can be paid. Unfortunately, landlord code not amended back immediately and benefit continues to be paid at new address rate to Non HRA landlord. Is this a Non HRA overpayment or a RA overpayment.

    In 1. and 2. above, would it make any difference if the overpaid benefit was at the Non HRA rate?

    4.
    Authority transfers stock to HA in September 2004. Overpayment raised in July 2005 for period January 2004 to August 2004. Is this a HRA overpayment or RA overpayment.

    I would say that the overpayment is RA. You are processing and paying a RA claim, therefore the fact that the person who receives the payment usually receives Non-HRA payments is immaterial.

    As the overpayment is the on-going RA claim, then it should be classed as RA.

    I don’t believe so. Whatever rate you are paying, you made payments of RA which are now classed as overpayments

    As the entire overpayment falls into the time that your claim was a RR HRA case, the overpayment will be RR rather than RA. If the overpayment period covered the period of the transfer you would have an overpayment that is part RR and part RA.

    You will need to check the tenancy and tenure types that you have set up for the relevant claims on your system. If you paid out benefit and the tenancy/tenure type on your system for the period that the payment covers is a Non HRA one and later you create an overpayment for the same period, the system should create a non HRA overpayment irrespective of what classification the claim may be currently listed as. For example the stock transfer cases where they are now Rent allowances, any overpayments generated covering the period they were HRA cases will be an HRA overpayment.
    Be careful if you retrospectively amend tenancy/tenure types to correct errors made in previous years as some systems get confused with the subsidy calculations with such cross year adjustments.
