Overpayments of Tax credits

    We have had a claimant who has had his Tax credits reduced from April, being notified of the overpaymnet in Dec .

    We have taken the amendment from December but the claimant is asking for it to go back to April.

    The TC guidance appears to suggest that we are right but it seems wron g that his housing benefits is not increased accordingly …… for the period where he has a massive overpayment of tax credits??

    Can’t see a problem with it myself.

    Between April and Decmber the claimant actually had the extra money.

    Following December the ongoing TC was reduced and you reduced your record of the TC income accordingly.

    Next year the claimant’s TC award will be reduced to take account of the remaining overpayment.

    You will take account of only this reduced amount next year.

    This leaves everyone square. (I think….)
