Parents learning Allowance

    Just a quick query as we have had a big debate on this 😆 , we know its disregarded for student loans but should the Parents Learning Allowance in a NHS Bursary award be disregarded when calculating income for HB and CTB?


    Probably – this is my least favourite of all the Regulatins because, unless you are an expert on the law relating to student finance, it is impossible to make any sense of it.

    Reg 59(2) says that you should disregard any grant income tha6t is intended to meet certain specific costs, including child care.

    Reg 59(4) says you should disregard the “grant for dependants known as the parents’ learning allowance” and paid under s22 of the Teaching and Higher Education Act 1988 or the Northern Ireland equivalent. Whether PLA paid to an NHS student is the same thing or not I have no idea. But I don’t think anyone is going to mind if you disregard it.

    Once again I will make my regular public plea to DWP for a student circular that cross-references Reg 59 to all the different kinds of student finance. As things stand, it seems we are supposed to award HB according to the guidance and hope we never have to support it in front of a Tribunal. The view seems to be that Reg 59 is there because those boring lawyers told us we have to have a regulation thingy, but you don’t really need to use it: the proper rules are in the guidance manual.
